Terms & Conditions

Once you have chosen a program, please read the terms and conditions as your booking is subject to the terms listed below. Payment for a reservation for any Peru Andes Explorer program or tour shall constitute consent to all the provisions in the Booking Terms & Conditions set out herein and is binding on all tours.

General

  • The program can change according to the weather conditions as well as to the wishes of the group.
  • Peru Andes Explorer cannot be held responsible for any loss or damage of the personal belongings of the client or any consequences due to the loss or damage.
  • We cannot take the responsibility for any sickness or accident that may occur. If you become sick or an accident occurs the responsibility and any associated costs lie with the client.
  • The client is responsible for the equipment lent to him, the total cost of damage or loss will need to be compensated for on return to Cusco.
  • The client declares that he or she is physically and mentally fit. Peru Andes Explorer cannot be held responsible for the consequences if this is not the case.

Booking Procedures (Deposit)

Please contact us before doing any payment. 50% deposit per person for the chosen program is requested at the moment of the booking. This deposit is non-refundable in case of cancellation by the client. Doing this you enter a contract with Peru Andes Explorer. We then accept and confirm the booking. Note that travel arrangements are not confirmed until stated so in writing by Peru Andes Explorer.

This Pre-payment of 50% can be done through WESTERN UNIONPAYPAL or payments Online. The transfer is to be made in the name of staff of Peru Andes Explorer.

Peru Andes Explorer will NOT pay any bank taxes and transfer costs. All transfer costs must be paid by the client.

Payment of Final Balance

  • The program price is in U.S. dollars. We require you to pay your final balance in our office at least 24 hours before your tour. Currently, we accept cash (Peruvian soles or American dollars) and Visa (they charge you 8% commission).
  • The program price per person is agreed at the moment of the booking confirmation and will neither increase nor decrease.

Cancellation by you

In case of cancellation by the client, this should be notified to Peru Andes Explorer in writing. Note that the deposit is non-refundable. Please state the reason for cancellation as you may be covered by your insurance policy.

If notification of cancellation is received more than 15 days before the departure, the client will lose the deposit of 50%. 15 to 7 days before departure, 50% of the tour price will be refunded only if 100% is paid in advance. Less than 48h before departure, no money will be refunded, also in case of cancellation of only a part of the tour.

Cancellation / Changes by us

Circumstances outside our control: technical problems, weather conditions, strikes, riots and decisions by the government.

In such cases, Peru Andes Explorer will propose solutions to operate the program or comparable travel arrangements but not refund money. We reserve the right to alter the scheduled itinerary accordingly. We will make every reasonable effort to provide you with the booked program arrangements but changes may occur.

If they are significant we will, if possible, inform you before the departure date. Again, we will offer comparable alternative arrangements. All additional expenses derived will be at the expense of the client. Please note that Peru Andes Explorer will not be responsible for reimbursing any additional expenses incurred by the client in preparing the tour. The foregoing includes international tickets and fees, cost of visas, vaccinations, among others.

Cancelations caused by Peru Andes Explorer: we will refund 100% of your payment.

Acceptance of Risk

Some of Peru Andes Explorer itineraries have been designed to provide participants with an exposure to the true nature of the environment visited. They therefore involve an element of personal risk, which could result in physical or emotional injury, paralysis, death, or damage to the client, his/her property or to third parties. The client understands that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity and therefore assumes them as part of the tour. Our client accepts that he/she is aware of his physical and health condition and that, under the knowledge of this he/she decides to undertake the above-mentioned risks. The client excludes Peru Andes Explorer from any responsibility linked to any accident or injury that may occur.

Authority on Tour

At all times the decision of the company’s guide or representative will be final on all matters likely to endanger the safety and well-being of the tour group. You have to follow the instructions of the guide at all times.

The client must at all times strictly comply with the laws and drug regulations of Peru. Should the client fail to comply with the above, or should the client interfere with the well being of the group then the guide or company representative may order the client to leave the tour without any refund.

Travel Documents

The client must be in possession of a valid passport. The original document or at least a copy has to be carried in the tour.

Travel Insurance

We strongly advise you to get travel insurance that covers accidents, medical expenses and emergency repatriation, including rescue and air ambulance. We also recommend that it covers cancellations and loss of luggage.

Third Party Services

Peru Andes Explorer directly operates part of the services included in a program but also makes arrangements with airlines, hotels and other independent parties to provide you with the travel services you purchase. We do take all reasonable steps to ensure that organizations providing services maintain our quality standards. However, these parties are independent suppliers over whom we have no direct full control.

Peru Andes Explorer can therefore not accept any liability for any, losses, damages, inconveniences, delays etc.

Claims and Complaints

If a client has a complaint against the company the client must first inform the guide while on the tour in order that the guide can attempt to rectify the matter. Any further complaint must be put in writing to the company within 7 days of the end of the tour.

Venue for claims or disputes shall be exclusively in Cusco, Peru, whose courts, using Peruvian Law, shall have exclusive jurisdiction.

Damage claims against Peru Andes Explorer shall be limited to the value of the particular item in dispute. Any liability is limited to the full price paid for the tour. In all cases the company specifically excludes all liability for indirect, incidental or consequential loss or expense including loss of profits.
